I got hit by a NO DL AND NO INSURANCE and I'm AT FAULT??? WTF

Every weekend on saturday we meaning some car enthuisiast usually go up to hooters and meet in the parking lot. We sit and chat for awhile and usually have a few races. We go to the highway do a 40, 60 punch etc..

Well this last saturday I was up there. A srt4 with some minor mods putting about 260whp down was going to race an M3. Of course with usual car meetings the ricers come. And also people that shouldnt even ****ing be there. Hence people that have cars that shouldnt be trying to race with us. So of course when the srt4 and the M3 go to race everyone and their dog comes and of course so do the dumb ****s. Well we get on the highway everythng is fine exept for some stupid people weaving and cutting people off for no reason not to mention **** cars. Well the first race happened from a 40 punch no problems. Well I accelerate to get a better view this time. I am in the far right lane of a three lane highway. There is a cement wall about 3 feet to right of me and then two lanes to the left. In the middle lane thier is a superchargeed grandam and a GT in the right lane
I was about 2 cars behind the GT and the grandam. I get on it so I can see the race. The GT and the grandam also get on it
well I pass the GT and then I am passing the grandam and I havent moved from the far right lane. when I am about halfway up on his car we are going about 110 the ****er swerves to weave around a car in front of him and sideswipes me. So I grab the wheel with both hands and push the clutch in the grandam slams on the brakes loses control spins out and hits the GT and flies through gaurd rail. WEll of course Im pisses as hell because my car is now ****ed up due to a stupid ass who wanted to run with the racers in a grand am. I pull over a bit ahead and walk back to see what happened because I didnt know at first cause I didnt turn around and look. VERY LUCKILY no one was injured but anyone life could have been taken. We were very lucky considering our speed of 110mph. So anways as IM walking abck with a friend a cop comes by and then the usualy chit chat and we drive back to the wreck. They asked me what happen and I told them he cut over into my lane etc. The driver of the grandam was a hispanic male and had no DL or insurance. So im already pissed about that. Well on monday I go to get the police report. WHAT THE ****. I am being put at fault in the wreck. They say that I was passing him and moved out of my lane into the middle and hit him causing him to spin out. I am so ****ing angry. SO now I ask what should I do? I really don't want to mess with court cause he proabably doesnt have money anyways. I just want my car repaired in full at no charge. I am being blamed for somehting I didnt do. I really am in shock. Its obvious he came into me. My fender is pulled back from when he slammed on his brakes...

well let me know what you guess think. They also were telling the cops we knew these people they were looking for. SO then the cops thought we were lying about that..its just a really ****ed up deal.

they may actually total it depending on the cost of the repairs. good luck. can you not specify who was at fault on the report? here in AL you can claim whether or not you were at fault. How many witnesses are there in your favor that you know that would testify? File a complaint with the department about the officer that wrote the report.

in ca if you have no dl or insurance you are 100 percent at fault no matter what.

wow, thats pretty crazy, but I have to say, you are a moron for being in that crowd and going 110+.. although it wasn't your fault, you wouldn't be in this situation if you had decent judgement at the time..

I hope you can prove to the cops that you are telling the truth though..

were you passing on the right? if so, a lot of cops will attribute that to the cause of the accident, placing you at fault.

Racing or not, you were still traveling at 110 mph on a public highway. It's obvious that there were many innocent people on the roads since you said others were swerving to avoid them.

You and all the others in your group are the reason why cops single modified cars out in the first place.

Take it to a track and don't endanger myself and my loved ones.

No sympathy from me. Maybe when you have to fix your car with your own money it will be an eye-opening experience.

^oh damn, I didn't actually READ all the little tidbids because i just didn't wanna strain my eyes lol.. I retort my previous reply up there, having now read a little more instead of looking at title/pictures.

No sympathy from me here either then. When you do stupid sh!t like that, you're askin for trouble. When I see guys like you on the freeway, even ones that arent racing, just swerving in and out or speeding like CRAZY, my gf and I just look and shake our heads; we sometimes get a little scared too that one of them will cause an accident right in front of us. I've seen it happen before.

1st off, yes the guy who hit you had no dl or insurance... but both of you were in a speed contest on public roads. hence technically both of you can be held at FAULT. That is the risk you take for ILLEGAL racing on public roads/highways/freeways etc. and yes luckily no one was hurt or died or this would be even more messy. Right now, there is no point for the cops to point the finger to the most likely "illegal immigrant" that was driving and hit you. Even if they found him guilty what are they going to do? sue him for the small $2/hr he makes? so all in all, ur pretty much screwed. if you made a police report, well, dunno what to say, i wouldn't have. I would have called my insurance and claimed hit and run, and go from there. this way, only ur insurance goes up if you want your car fixed (that is if u have full coverage).
