it depends on legality issues...iirc, ur not supposed to put an older motor into a newer car...if ur car is a 96, which is OBD-II, ur supposed to keep compliance with another newer motor that is also OBD-II (assuming not all H22's are OBD-II)....this is assuming i read ur question properly...

same deal...im not 100% familiar with engine codes, but if the motor is OBD-II, then u will have to bring the car that ur dropping the motor into up to OBD-II emissions standards...one example i can think of is proper catalytic converter....OBD-II cats cost 2x as much as OBD-I cats...not to mention the OBD-II ecu's have a secondary O2 sensor where the cat is....

It matters mostly in California. This brings up an important point...Does anybody know of a comprehensive database that has all the CARB regulations and engine swap guidelines for the great state of California?

http://www.arb.ca.gov/msprog/aftermkt/replace.htm

As it turns out the engine does not have to the same year or newer (I had always herd/believed this as well)... Just functionally equivalent... I actually called the ARB when an engine supplier shipped me a 93 H22 that had been improperly upgraded to OBD II specs. They said the date of manufacture does not matter. Bastards are never on my side!

[EDIT]

Oh... And as far as a 96 H22 swap goes... Should not cost you too much more of the engine/clip IF you can find it... And that was the big if.... I called 3 or 4 places and could not get my hands on one... Had a lot of places that offered to call me if they found one... But none sounded to hopeful.

You can bring a pre 96' up to spec if you have a 96 car with all the various emissions bits in it... Then you just need to replace the oil pump in the block with a 96 or later model that had the mounting point for a crank angle sensor... And swap that from your old engine as well...

If your not starting with a 96, then for god sake don't do it!

yes but if he is putting an older motor into a 96+ (which is the first year for OBD-II), then u will have to do wutever is needed to make it OBD-II compliant as well...
