As it turns out the engine does not have to the same year or newer (I had always herd/believed this as well)... Just functionally equivalent... I actually called the ARB when an engine supplier shipped me a 93 H22 that had been improperly upgraded to OBD II specs. They said the date of manufacture does not matter. Bastards are never on my side!

Oh... And as far as a 96 H22 swap goes... Should not cost you too much more of the engine/clip
IF you can find it... And that was the big if.... I called 3 or 4 places and could not get my hands on one... Had a lot of places that offered to call me if they found one... But none sounded to hopeful.
You can bring a pre 96' up to spec if you have a 96 car with all the various emissions bits in it... Then you just need to replace the oil pump in the block with a 96 or later model that had the mounting point for a crank angle sensor... And swap that from your old engine as well...
If your not starting with a 96, then for god sake don't do it!
