It stays on constantly at night when the lights are on. When you apply the brakes they light up a little bit. SO what the heck is wrong?

It is simply tapped into the wrong factory wires from the tail lights.

If you have a test light, finding out which wires to use is simple. You will also need someone in the car to step on the brake while you probe the wires.
