HELP Got into accident....

I got into an accident a little over a month ago, and we didn't file a poilce report. The person who hit me was driving a 00 Camaro z28 and we were side by side when he fish tailed and hit me. We didn't file a poilce report then (But we should have, and I eventually filed one and sent it to the department of highway patrol...) He told me he would pay me out of pocket but he hasn;t yet... so I contacted his insurance company..I have 4 witnesses, two that were in my car, one that was in the camaro and another person who was driving behind us and saw it all.

I called his insurance company but they denied my claim because he claimed a hit and run and were protecting their client..

This really sux.. I need some legal advice. What should I do? The adjuster came out and looked at the car and said "he can tell we were racing" by the damages... but there is no way to prove it. He might have been racing,. but that doesnt mean I was...

I already called my insurance company and they have my claim with them the night that it happened, but since I dont have full coverage they couldn't help me.

What should I or will I have to do to get my compensation for the damages?

please help...

P.S. Damages estimated at 2500-3500

pass fender, hood, rebar, front bumper, pass headlight, pass door, pass rear quarter panel, motor mount, possibly radiator core support (bent)

Given the length of time since the accident and since there is no police report definitively placing the Camaro driver at fault...the insurance company just has his word against yours. I don't believe they will pay you for your damages. It sounds like you will have to pick up the tab for those repairs on your own.

you really shouldve filed a police report, you porbably have to pay your deductable now to pay for your damages, its been too long

well since you waited so long you may just be **** out of luck. And since you didn't fill out a police report they have no evidence of it actually happening.

There is a police report, it doesnt place anyone at fault though. I filled out it a few weeks after it happened. Im thinking about taking it to small claims court...

I need some postitive advice please...

Laywer up or take a loss. ANY time you get into an accident get a police report, even if you think it's your fault. I would have given the guy 24 hours to pony up the cash then called his insurance. We all learn from our mistakes.

A few rules to follow when in an accident:

1. Always call the cops.
2. Always get tons of witnesses.
3. Never ever trust a domestic.

if you did file a police report (even later) then you might have something....just contact your ins. co. an have them deal w/ the other ins. co. if you've got the witnesses info, then you can use that to prove that it wasn't a hit an run
